1) For the purposes of concluding contracts and providing services through the Platforms, we process your personal data that you provide by filling out forms/ which you provide when registering in our e-shop and executing a purchase and sale contract , sending inquiries and messages through the Platforms, as well as when you make subsequent contact with us in the course of considering your inquiries and messages. The data you provide is necessary for us to provide information and send notifications about everything related to the services you use with us.

"Ballistic" Ltd. collects and processes your personal data in connection with the use of the website and online store https://www.ballistic-sport.com, concluding contracts with the company on the basis of Art. 6, para. 1, Regulation (EU) 2016/679, and in particular on the basis of the following grounds:

  • Explicit consent received from you as our client;
  • Fulfillment of obligations under a contract with you;
  • Compliance with a legal obligation that applies to "Balistik" OOD;
  • For the purposes of the legitimate interests of "Balistik" OOD or a third party.

"Ballistic" Ltd. collects and processes the personal data provided by you in order to fulfill the obligations under the contract, including for the following purposes - accounting and commercial purposes, ensuring the performance of the contract, protecting information security.

On this basis, we process information about the type and content of the contractual relationship, as well as any other information related to the contractual relationship, including:

  • personal contact details – names, email, telephone number;
  • other information such as: delivery address;
  • information about the inquiry sent to us;
  • correspondence in connection with the overall service - e-mail, letters, information about your requests for troubleshooting, complaints, requests, grievances, feedback we receive from you;
  • A unique number for a user has been created;
  • Information from your actions on the site;
  • IP address;

When do we delete data collected on this basis?

We delete the data collected on this basis 5 years after the termination of the contractual relationship, whether due to the expiration of the contract, termination or other reason.

2) Direct marketing – if you have provided consent to receive marketing communications, we will collect and process your personal data for the purpose of sending offers for the products/services in which you are interested. In this regard, we may send you commercial communications through the following electronic communication channels , which contain general and thematic information; information about products, complementary services and other business communications:

  • Viber offering products and services of "Balistik" Ltd. by sending advertising messages through the "Viber" application after receiving your explicit consent.

On this basis, we only process data for which you have given us your explicit consent. The specific data is determined in each individual case. Typically, this data is names, telephone number, email address and delivery address.

Providing data to 3rd parties

On this basis, we may provide your data to marketing agencies, Facebook, Google, other social networks or other entities for the purposes of fulfilling the contractual relationship.

When do we delete data collected on this basis?

We delete the data collected on this basis upon your request or 12 months after its initial collection.

Withdrawal of consent

The consents granted may be withdrawn at any time by sending an email to us at the contact email address provided. The withdrawal of consent has no impact on the performance of contractual obligations. If you withdraw your consent to the processing of personal data in any or all of the ways described above, we will no longer use your personal data and information for the purposes specified above. The withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.

  • Restriction of processing by the controller or processor of personal data;
  • Portability of personal data between individual administrators;
  • Objection to the processing of his/her personal data;
  • The data subject also has the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning the data subject or similarly significantly affects him or her;
  • Right to judicial or administrative redress in the event that the data subject's rights have been violated.

The user may request deletion if one of the following conditions is met:

  • The personal data are no longer necessary for the purposes for which they were collected or otherwise processed;
  • The user withdraws his/her consent on which the data processing is based and there is no other legal basis for the processing;
  • The data user objects to the processing and there are no overriding legal grounds for the processing;
  • The personal data has been processed unlawfully;
  • The personal data must be erased for compliance with a legal obligation under Union or Member State law to which the controller is subject;
  • The personal data were collected in connection with the provision of information society services to children and consent was given by the person with parental responsibility for the child.

In case the User wishes to have his/her personal data deleted, he/she should send his/her request to the Personal Data Administrator at the email address specified above. After deleting your account, the Administrator will take the necessary care to delete and destroy all your data without undue delay or to anonymize it (i.e. to render it in a form that does not reveal your identity).

The user has the right to restrict the processing of his/her personal data by the administrator when:

  • You contest the accuracy of the personal data. In this case, the restriction of processing is for a period that allows the controller to verify the accuracy of the personal data;
  • The processing is unlawful, but the User does not want the personal data to be deleted, but instead requests a restriction of their use;
  • The Administrator no longer needs the personal data for the purposes of the processing, but the User requires them for the establishment, exercise or defense of legal claims;
  • Object to the processing pending verification of whether the legitimate grounds of the administrator override the interests of the User.

Right to portability

The data subject shall have the right to receive the personal data concerning him or her, which he or she has provided to a controller, in a structured, commonly used and machine-readable format and shall have the right to transmit those data to another controller without hindrance from the controller to whom the personal data have been provided, where the processing is based on consent or a contractual obligation and the processing is carried out by automated means. When exercising the right to data portability, the data subject shall also have the right to obtain the direct transmission of the personal data from one controller to another, where technically feasible.

Right to object

Users have the right to object to the processing of their personal data to the controller. The controller shall be obliged to stop the processing unless it demonstrates compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject, or for the establishment, exercise or defence of legal claims. In the event of an objection to the processing of personal data for direct marketing purposes, the processing shall cease immediately.

Complaint to the supervisory authority

Every User has the right to file a complaint against unlawful processing of his/her personal data to the Personal Data Protection Commission or to the competent court.
